Procedure for Submitting a Notice of Alleged Copyright Infringement

If you are a copyright owner or an agent thereof and believe that material available on our website infringes upon your copyright, please submit a written notice containing the following information to our Designated Copyright Agent (contact details provided below):

  1. Identification of the copyrighted work claimed to have been infringed: Please provide sufficient detail to identify the copyrighted work that you believe has been infringed.

  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Procedure for Handling Notices of Copyright Infringement

Upon receipt of a valid notice of alleged copyright infringement that complies with the requirements above, APKOpen.net will take the following steps:

  1. Review the notice: We will review your notice for completeness and compliance with the DMCA requirements.
  2. Removal or disabling of access: If your notice is valid, we will remove or disable access to the allegedly infringing material.
  3. Notification to the affected user: We will make a good faith effort to notify the user who posted the allegedly infringing material and provide them with a copy of your notice.
  4. Counter-notification procedure: The affected user may submit a counter-notification in accordance with the DMCA requirements if they believe that the material was removed or disabled as a result of mistake or misidentification.
  5. Restoration of material: If we receive a valid counter-notification, we may restore the removed or disabled material after a specified period, unless the copyright owner files an action seeking a court order to restrain the alleged infringer from engaging in the infringing activity.

Counter-Notification Procedure

If you believe that your material that was removed or to which access was disabled is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our Designated Copyright Agent (contact details provided above):

  1. Your contact information: Your full name, address, telephone number, and email address.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we may provide a copy to the person who submitted the original notice of alleged infringement and inform that person that we may reinstate the removed material or cease disabling access to it in 10 to 14 business days. We will not reinstate the material if the original notifying party informs us that they have filed an action seeking a court order to restrain you from engaging in the infringing activity.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, APKOpen.net has adopted a policy of terminating, in appropriate circumstances and at APKOpen.net’s sole discretion, users who are deemed to be repeat infringers.
